Impact/Mobility Fees 

LEGAL UPDATE: Palm Beach County Road Impact Fees and Palm Beach Gardens Mobility Fees

 

On October 1, 2024, CS/HB 479 will become effective. CS/HB 479 was supported by the Home Builders Association, the Association of Florida Community Developers, the Florida League of Cities, and the Florida Association of Counties. CS/HB 479 will have the following effects on development/redevelopment in the City of Palm Beach Gardens ("City") in the following manner:

 

1. Traffic concurrency review, pursuant to the Palm Beach County Traffic Performance Standards Ordinance, will no longer be required for any development/redevelopment within the City's Mobility Plan/Mobility Fee zone (primarily east of the Beeline Highway). Only the City's Mobility Fee will be charged and collected within the City's Mobility Plan/Mobility Fee zone. The subject fee will be collected by the City. Palm Beach County impact fees will neither be charged nor collected within the City's Mobility Plan/Mobility Fee zone.

 

2. Traffic concurrency review is required outside of the City's Mobility Plan/Mobility Fee zone.

 

3. Any County Road impact fees that are due (excluding proportionate share payments) will be collected by the City and held in escrow for release to the County at such time as the County constructs the required improvement(s).

 

4. Existing Proportionate Share Agreements remain in full force and effect, as they are not affected by the new law.


Letter to all prospective Developers, Contractors, and/or Impact Fee Payer

Overview

The purpose of impact fees is to ensure that new development bears a proportionate share of the cost of capital expenditures necessary to provide fire rescue, police, parks and recreation, roadway and mobility services, and public facilities in the City of Palm Beach Gardens.

On September 19, 2019, the City Council approved Ordinance 19, 2019 which revised the city's impact fees to include a new fee for mobility to replace road impact fees for certain lands in the City. Please click here for more information on the mobility study.

Section 78-95 of the City's Land Development Regulations requires a periodic review of the schedule of impact fees to update costs, credits, and generation rates. 

On December 6, 2023, the City Council adopted Ordinance 5, 2023 Ordinance 05-23 approved an update to the City’s Impact Fee Schedule for Fire Protection/EMS, Police Protection, Parks and Recreation, and Public Facilities. The update to these impact fees, including a finding of extraordinary circumstances, was approved by the City Council with an effective date of April 1, 2024. On May 1, 2025, the City Council adopted Ordinance 4, 2025. Ordinance 4, 2025 approved an update to the City’s Mobility Plan and Fee Schedule to be Citywide, including a finding of extraordinary circumstances, with an effective date of August 4, 2025. Please see the required 90-day public notice regarding the Mobility Fee update.

The following impact fee schedule are the fees necessary for development in Palm Beach Gardens prior to April 1, 2024. However, the road impact fees and mobility fees listed below remain effective until August 4, 2025. The mobility fee is applicable to areas east of Beeline Highway and the road impact fee is applicable to areas west of Beeline Highway. Please see the “Road” and “Mobility” columns in the schedule below for reference of these fees.
